On 27 May 2021, the International Scientific Conference “The impact of digital platforms and social media on freedom of expression and pluralism – in general terms” took place in Warsaw, which was organised within the Central European Professors’ Network 2021 by the Institute of Justice in Warsaw, in cooperation with the Ferenc Madl Institute of Comparative Law and the Central-European Association for Comparative Law.

 

This was the first event piloted by Polish academics within the Central European Professors’ Network 2021. It is worth pointing out that the Central European Professors’ Network includes academics from countries such as the Czech Republic, Croatia, Poland, Hungary, Serbia, Slovakia and Slovenia. The aim of this project is to draw the attention of European citizens to topics that are important and relevant to the future of Europe, in particular Central Europe.

 

The main theme of the conference “The impact of digital platforms and social media on freedom of expression and pluralism – in general terms” were two issues related to the functioning of social media and their impact on freedom of expression and pluralism, i.e:

-          an analysis of the impact of fake news on the Internet in relation to freedom of expression and pluralism of opinion;

-          an analysis of the impact of online censorship on freedom of expression and pluralism of opinion.

Religious symbols in public sphere in the legal orders of Central and Eastern European countries

On 28 May 2021, the International Scientific Conference entitled “Religious symbols in the public sphere in the legal orders of Central and Eastern European countries” took place in Warsaw, which was organised within the Central European Professors’ Network 2021 by the Institute of Justice in Warsaw, in cooperation with the Ferenc Mádl Institute of Comparative Law and the Central-European Association for Comparative Law.

 

The conference was one of the events of the Research Group “Freedom of Conscience and Religion in Europe”.

 

The concept of the conference: The discussion about the presence of religious symbols has been going on in European realities for several decades. It is often marked by enormous emotional intensity, reflecting the attitude of society to the basic values on which European culture and civilization are based, and it also testifies to the Christian identity of nations.

 

The main assumption of the analysis is to show the normative aspect in the selected European countries relating to the possibility of manifesting one’s beliefs through religious symbols. The position of the judiciary, expressed both by international bodies and by the national judicial system, plays a fundamental role in shaping the contemporary model. It should also be emphasized that historical conditions also have an impact on the presence of religious symbols in public space. The conducted research will show the right of believers to manifest their religious feelings in public space while respecting the separateness and tolerance of people with different views.

The Oxford debate entitled ”Censorship in Social Networks and Fake News in Social Networks” was held on May 31, 2021, from 10 a.m. to 1 p.m., by means of remote communication.

 

The event was organized by the Institute of Justice, Ferenc Mádl Institute of Comparative Law, Central-European Association for Comparative Law and the Scientific Circle of Criminal Procedure of the Cardinal Stefan Wyszyński University in Warsaw.

 

The Oxford Debate was organized within the framework of the Central European Professors’ Network 2021.

On 1 June 2021, the International Scientific Conference “The impact of digital platforms and social media on freedom of expression and pluralism – view of young researchers” took place in Warsaw, which was organised within the Central European Professors’ Network 2021 by the Scientific Circle of Criminal Procedure of the Faculty of Law and Administration of the Cardinal Stefan Wyszyński University in Warsaw and the Institute of Justice in Warsaw, in cooperation with the Ferenc Madl Institute of Comparative Law and the Central-European Association for Comparative Law.

 

The conference was organised as a dissemination event of Bartłomiej Oręziak, the member of the research group titled The Impact of Digital Platforms and Social Media on Freedom of Expression and Pluralism.

 

The main aim of this event was to enable young researchers to present their research results. The conference was based on two main key issues:

-          analysis of the influence of Fake news on the internet with regard to the freedom of expression and pluralism of opinions;

-          analysis of the influence of censorship on the internet with regard to the freedom of expression and pluralism of opinions.

Protection of family in the legal system

The conference entitled ‘Protection of family in the legal system’ was organised as part of the Central European Professors’ Network 2021 event. The conference aimed to provide comprehensive and up-to-date insights into the issue of the legal protection of families in the Central European region.

 

Country experts from across the region presented their research results on issues related to family law. The Central European Professors’ network, with the active participation of experts from seven countries (i.e. Czech Republic, Croatia, Poland, Hungary, Serbia, Slovakia, and Slovenia), organises events with the primary aim of drawing the attention of European citizens to significant topics concerning the future of Europe, with a focus on Central Europe.

 

The issue of family protection is crucial for Europe in the 21st century.

 

Key issues reviewed at this event included:

-          the significance of marriage and family as universal human rights and fundamental values,

-          non-legal and legal tools of social and state protection of marriage and family, and

-          legal protection of marriage and family in the case law of the European Convention on Human rights (ECHR) and the Court of Justice of the European Union (CJEU).

 

The main event organisers were the Ferenc Mádl Institute of Comparative Law, Hungarian Association for Comparative Law and Central-European Association for Comparative Law.

Interpretation of fundamental rights in the practice of the constitutional courts of Central and Eastern Europe

The conference entitled ‘Interpretation of fundamental rights in the practice of the constitutional courts of Central and Eastern Europe’ was organised as part of the Central European Professors’ Network (CEPN) 2021 event by the Ferenc Mádl Institute of Comparative Law, the Central-European Association for Comparative Law and the Hungarian Association for Comparative Law. Having regarded the pandemic situation, the conference was held in hybrid form: presenters and the audience were present both in person and virtually as well.

 

The conference was aimed to providing a comprehensive sight the interpretation of fundamental rights by presenting the practice of the constitutional courts of Central and Eastern Europe. The issue of fundamental rights is crucial for Europe in the 21st century, particularly in light of the COVID-19 pandemic. Accordingly, three key issues reviewed at this conference included: (a) an introduction to the constitutional courts of each country (historical background, the organisation and the structure of the courts, rules of procedure, main functions, etc.); (b) the role of the constitutional courts in the interpretation of fundamental rights; (c) the impact of the COVID-19 epidemic on the interpretation and restriction of fundamental rights in the case law of the constitutional courts. The latter topic is particularly important nowdays, because tackling the state of emergency caused by the COVID-19 epidemic and guaranteeing people’s right to life and health require restrictions on certain fundamental freedoms.

The application and interpretation of fundamental rights in civil cases

The online conference was held as a dissemination event relating to the research project on the ‘Interpretation of fundamental rights in Europe’, carried out within the framework of the Central European Professors’ Network coordinated by the Ferenc Mádl Institute of Comparative Law, the Hungarian Association for Comparative Law and the Central-European Association for Comparative Law, and in cooperation with the Károli Gáspár University of the Reformed Church, Faculty of Law, Hungary.

 

The aim of the online conference was to explore how national ordinary courts, constitutional courts, supreme courts, or international courts, especially the European Court of Human Rights and the Court of Justice of the European Union (ECJ), apply and interpret fundamental rights in civil cases.

 

PhD students, young researchers, and lecturers coming from different countries of Central and Eastern Europe (Czech Republic, Hungary, Poland, Serbia, and Slovenia) gave research talks on the topic.

Local and national characteristics of family protection in Central Europe

The Central European Professors’ Network, consisting of four research groups, launched its activities on 1 January 2021 to conduct research on a great variety of issues with regard to seven Central European countries (Hungary, Poland, Czech Republic, Croatia, Slovakia, Slovenia, Serbia). The Professors’ Network organises events with the primary aim to draw attention of the European citizens to the topics which are important and significant in connection with the future of Europe, in particular of Central Europe.

 

One of the research groups has dealt with the impact of the enforcement of family rights and family protection. Furthermore, the group has focused on the non-legal and legal instruments of social and state protection of marriage and the family in field of domestic and international law. It analysises the definition of ‘family’ and the specific normative levels of ‘family definition’ in the national law; the legally recognised forms of kin family relationships; the legal framework of parent-child relationships; and the differences between the rights of children born out of marriage and children born out of wedlock.

 

The conference on the above issue will also function as a book launch of the „Family Protection From a Legal Perspective – Analysis on Certain Central European Countries” written by the members of the research group. Therefore, besides the conference presentations, the comparative legal book will also be presented as the main achievement of the research team. This book is a gap-filling contribution in the field of comparative constitutional law and a publication which sheds light on the most important Central European aspects of the issue.

The Professors’ Network organises events with the primary aim to draw attention of the European citizens to the topics which are important and significant in connection with the future of Europe, in particular of Central Europe.

 

One of the research groups has dealt with the impact of social media on the freedom of expression and its constitutional relevance in Central Europe. Furthermore, the group has focused on the comparative legal analysis of censorship, as well as of social networks and forms of expression which may threaten European values, democracy, human rights and the rule of law, such as disinformation campaigns aimed at spreading fake news on social media and other networks.

Sustainable Finance in European Jurisdictions

The necessary path to a carbon-free economy will only be achievable with a fundamental transformation of essential sectors. Above all, there is a need to channel private capital into sustainable enterprises. The acceptance of this epoch-making project depends on the coherence of the legal framework to be created. So far, there are mainly regulations that can be summarized under the catchword “sustainable finance”, they concern shareholder governance, fund governance and product governance issues.

 

The aim of the Conference „Sustainable Finance in European Jurisdictions” is to investigate the implementation of this regulatory program from a comparative law perspective in order to uncover inconsistencies and, if necessary, to identify any need for action on the part of the European and the national legislators.
